This Website, which includes the Inner Compass Initiative domain (www.theinnercompass.org) and The Withdrawal Project sub-domain (withdrawal.theinnercompass.org) (collectively, “ICI/TWP”), and ICI Connect and TWP Connect (collectively, “Connect”), is a web-based online information-sharing and connecting platform (collectively, the “Website”) which seeks to provide opportunities for likeminded people to find each other, and to facilitate the sharing of information that improves collective understanding of psychiatric drug withdrawal and of “mental health” diagnoses and treatments generally. These Terms and Conditions (“Terms”) apply to the Website, Connect platforms, and any content posted by, through, and in connection with ICI and ICI/TWP.
 
These Terms, together with Our Privacy Policy, Our complete Medical Disclaimer, Our website footer Medical Disclaimer, Our ICI Connect Pledge, and Our TWP Connect Pledge, incorporated herein by reference, and as modified from time-to-time, govern the use of this Website by general Users (“Users”) and by registered members of Connect (“Members”). By using the Website, You, as either a User, a Member, or both a User and Member, represent and warrant that You have read and understood and agree to be bound by these Terms and any and all policies and guidelines incorporated by reference.

Dispute Resolution and Governing Law
 
These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Massachusetts any dispute which stems from the operation of, or posting or publication of information on, the website by a User or Member or ICI shall be subject to binding arbitration by Judicial Arbitration and Mediation Services, Inc. (“JAMS”) in Boston, Massachusetts.  Further, all such disputes shall be arbitrated, governed by, and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Information and content posted within these Communication Systems may be provided by ICI staff, ICI's outside contributors, or by Users or Members not connected with ICI, some of whom may employ anonymous Member names. ICI expressly disclaims all responsibility and endorsement and makes no representation as to the validity of any opinion, advice, information, or statement made or displayed in these forums by third parties, nor is ICI responsible for any errors or omissions in such postings, or for hyperlinks embedded in any messages. Reporting Abusive Behavior
 
If You have become the target of abusive activity or are seeing it take place on the Website, please take the following actions:

  2. Do not reply to email(s) or message(s) from the Member who is being abusive.
  3. Report the Member to ICI by sending an email to hello@theinnercompass.org. Please include any relevant information or copies of messages to clarify Your complaint. 

 
Enforcement Against Abusive Behavior
 
ICI reserves the right to deny or cancel membership to Connect, or delete a Member’s profile, at any time, for any reason, with or without notice or explanation.
 
Without assuming any obligations expressly disclaimed herein, ICI reserves the right to take action in response to any abusive behavior on the Website including, but not limited to:
 

  1. Saving copies of the messages in the Communication Systems.
  2. Investigating allegations that a communication(s) do(es) not conform to the Terms or any other ICI policy to determine in its sole discretion whether to remove or to request the removal of the communication(s).
  3. Removing communications which are abusive, illegal, or disruptive, or that otherwise fail to conform with the Terms.
  4. Terminating a Member's access to his/her account and/or to the Website upon any breach of the Terms.
  5. Editing or deleting any communication(s) posted in the Communication Systems, regardless of whether such communication(s) violate these standards.
  6. Reporting direct threats of physical violence to law enforcement.


Membership Termination
 
You have the right to terminate Your Membership and delete Your Member profile and account at any time. Note that deletion of Your profile does not automatically delete contributions that You may have made to publicly visible areas of the Website including but not limited to discussion or comment threads. See Our Privacy Policy for more information. The processes for Membership and account disabling and cancelation are explained on the ICI Connect home page and TWP Connect home page.
 
You agree that ICI may, with or without cause, immediately terminate Your membership to ICI Connect or TWP Connect without prior notice. Without limiting the foregoing, the following may lead to a termination by ICI of a Member's membership and use of Connect: (a) breaches or violations of this Terms and Conditions agreement or other incorporated agreements or guidelines, or (b) a non-functioning or unattended email address attached to a profile for a prolonged period of time.

In the event of cancellation or termination, You are no longer authorized to access the part of the Website affected by such cancellation or termination. The restrictions imposed on You with respect to material downloaded from the Website, and the disclaimers and limitations of liabilities set forth in these Terms of Service, shall survive.


Refund Policy

Class Action Waiver
 
You may only resolve disputes with Us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren't allowed.
 
The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.
 
 
Severability
 
If any clause within these Terms (other than the Class Action Waiver clause above) is found to be illegal or unenforceable, that clause will be severed from these Terms, and the remainder of these Terms will be given full force and effect. If the Class Action Waiver clause is found to be illegal or unenforceable, these entire Terms will be unenforceable and the dispute will be decided by a court.


General Provisions

These Terms shall be binding upon and inure to the benefit of ICI and Our respective assigns, successors, heirs, and legal representatives. Neither these Terms nor any rights hereunder may be assigned without the prior written consent of ICI. Notwithstanding the foregoing, all rights and obligations under these Terms may be freely assigned by ICI to any affiliated entity or any of its wholly owned subsidiaries.
